Protecting You From Unfair Debt Collection Practices
The Fair Debt Collection Practices Act is a law that was designed to protect consumers from abusive, deceptive and unfair debt collection practices. If you think you are a victim of unfair debt collection, our lawyers offer a free initial consultation to evaluate your case. From our offices in midtown Manhattan, the Bronx and White Plains, we represent consumers throughout the New York City area.
Abusive Practices by Debt Collectors
There are many debt collection practices that are unfair. In particular, many consumers have problems with debt buyers. Debt buyers are companies that buy debt from other companies and then try to collect those debts from consumers.
Example:
You owe $1,500 to ABC Creditor, who sells your debt to XYZ Collection Agency. XYZ Collection Agency then sends you a letter threatening legal action against you if you do not pay the debt.
What Can I Do if I Receive a Letter From a Debt Collector?
Many debt collection letters are in violation of the Fair Debt Collection Practices Act. Some of these violations are very technical. If you receive a collection letter from a debt collector or collection lawyer, our lawyers will examine the letter at no charge. If it is in violation of the Fair Debt Collection Practices Act, our lawyers may sue the debt collector and recover damages for you.
As the consumer, you can recover actual damages, up to $1,000 in statutory damages, plus attorney fees and court costs. If we are successful in recovering damages for you, the bill collector will pay your legal fees.
